Most people know about Dieselgate from 2015, when Volkswagen was caught cheating emissions tests on 11 million cars with the EA189 engine. But the problem turned out to be much bigger.
Nearly all European diesel vehicles use so-called “thermal window” technology — software that automatically reduces emissions cleaning at lower temperatures. The CJEU ruled in 2022 that this constitutes a prohibited defeat device. In September 2025, a German administrative court (OVG Schleswig-Holstein) went further: Volkswagen’s 2016 software update — the supposed “fix” — was itself a new illegal defeat device, and the KBA’s type approval of it was unlawful. Approximately 200 type approvals must be reviewed.
The result? Millions of European car owners may be entitled to compensation.

✅ Supreme Court victory — Dieselgate Groups 1 and 3:
On 12 May 2026, the Supreme Court Appeal Committee unanimously overturned the Court of Appeal’s dismissal of the class actions (HR-2026-1104-U). The case has been sent back to the Court of Appeal with three binding instructions — including that the court must assess the principle of effectiveness, triggered by the EU Commission’s letter. Our brief was filed 27 May, the opponents’ response on 3 June. The Court of Appeal will now decide without further notice. Nine media outlets have covered the victory. Regardless of the outcome in Norway, ClaimShare has multiple independent EU legal pathways to compensation.

Can I participate if I sold the car?
